General conditions

Introduction

This contractual document shall govern the General Terms and Conditions for Contracting products (hereinafter, “Conditions”) through the website owned by HYGGE SEVILLA, SLU, hereinafter, HOTEL PLACIDO Y GRATA, whose contact details also appear in the Legal Notice of this website.

HYGGE SEVILLA, SLU, acts in the commercial trade under the National Trademark “PLACIDO Y GRATA”, with trademark number M4093346, all rights reserved.

These Conditions may be modified at any time. It is the responsibility of the USER to read them periodically, as those in force at the time the orders are placed will be applicable.

Contracts shall not be subject to any formality, with the exception of the cases expressly indicated in the Civil Code and the Commercial Code, and in this or other special laws.

Acceptance of this document implies that the USER has read, understands and comprehends what is set forth herein, has full capacity to contract, and assumes all the obligations set forth herein.

These conditions shall have an indefinite period of validity and shall be applicable to all contracts made through the website www.placidoygratahotel.com.

HOTEL PLACIDO Y GRATA reserves the right to unilaterally modify the conditions, without affecting the goods or promotions that were purchased prior to the modification.

Identity of the contracting parties

On the one hand, the provider of the services offered on this website www.placidoygratahotel.com, the Spanish entity HYGGE SEVILLA, SLU, with registered office at Plaza Nueva, 8B, 4ºE, and CIF B-90315219, a company registered in the Mercantile Register of Seville, in Volume 6358 General Companies, Folio 301, Section 8ª, Page SE-113377, Entry 1ª.

And on the other hand, the USER, who is responsible for the veracity of the personal data provided to HOTEL PLACIDO Y GRATA. In any case, the USER must be of legal age in accordance with current regulations in Spain. Minors of legal age must be accompanied by their parents, guardians, curators, or adult person duly authorised by any of the above.

Object of the contract

The purpose of this contract is to regulate the general conditions of contracting the reservation services of HOTEL PLACIDO Y GRATA and the USER at the moment that the USER accepts, during the online contracting process, the corresponding box.

The contractual relationship of purchase and sale involves the provision of the services of HOTEL PLACIDO Y GRATA, in exchange for a specific price and publicly displayed through the website.

Booking procedure

Unless otherwise stipulated in writing, the making of a reservation shall imply the acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those indicated in this document if it has not been expressly accepted in advance and in writing by HOTEL PLACIDO Y GRATA.

The USER, in order to access the booking services offered by HOTEL PLACIDO Y GRATA, must have full capacity to act. The USER must freely and voluntarily provide the personal data that will be required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data and Organic Law 3/2018 of 5 December (LOPDGDD) on the protection of personal data and guarantee of digital rights.

For the purposes of the European Data Protection Regulation and the Organic Law on Data Protection and implementing regulations, you are informed that the data provided by you will be processed for the purpose of providing the booking services contracted through our website, the data controller being HYGGE SEVILLA, SLU. Under no circumstances will we pass on your personal data, nor will they be communicated or transferred internationally to third parties, unless we are required to do so by law, or unless we have your express consent. On the other hand, we inform you that at any time and free of charge, you may exercise your rights of access, rectification, cancellation and opposition, as well as those of limitation and portability of your data, as well as make a claim before the Spanish Data Protection Agency, by sending us an email to hola@placidoygratahotel.com. For more information on data protection, please consult our privacy policy. 

Once the booking has been made, the USER will receive a confirmation e-mail. The confirmation email will include the dates of arrival and departure, the reservation made and the total price of the same, as well as the payment conditions linked to the rates in force at the time of booking, including taxes and fees for the operation. In the event of any variation in prices from the time the reservation is made to the date of arrival, this shall not affect the reservation made, and shall be maintained in its entirety, regardless of the variation in the tax rate applicable to the operation, in accordance with the principle of delivery of the service.

The charge corresponding to the reservation will be made through the REDSYS payment gateway. The USER of the reservation must match the holder of the credit card, which will be requested for the corresponding verifications.

Early cancellation of the reservation by the USER will not incur any charges, unless it occurs insufficiently in advance of the day of arrival, in accordance with the conditions of the contracted rate, or unless the contracted rate is non-refundable.

Correct use of the facilities

The misuse of the facilities of HOTEL PLACIDO Y GRATA is prohibited, and the USER is obliged to respect at all times the law, morality, public order and customs of Spain, refraining from acts contrary to these. The client will be responsible for covering the costs of repair or replacement in the event of breakage or damage to the hotel furniture that is a result of its use or negligence.

Smoking is prohibited in all hotel facilities as provided by Law 42/2010, of December 30, which modifies Law 28/2005, of December 26, on sanitary measures against smoking, and the Hotel may impose a financial penalty to anyone who fails to comply, with reservation of the right of admission.

HOTEL PLACIDO Y GRATA is Dog Friendly, so the presence of dogs is allowed in the establishment, upon request and payment of a daily supplement. The client must accept and sign the pet agreement provided by the Hotel at the reception before the entry of the pet. Any damage or damage caused by the pet during the stay will be the responsibility of the client.

HOTEL PLACIDO Y GRATA reserves the right of admission with respect to USERS who do not comply with this clause.

Check-In

The USER must check-in from 2 p.m. on the day of booking. In case of no-show on the indicated check-in day, a penalty equal to the total amount of the reservation will be applied.

If the USER requests the room before 2 p.m. on the day of booking, the Hotel may charge the costs incurred for Early Check-in.

Check-Out

The USER must check out before 12 noon. If the client wishes to extend their stay beyond this time, they must notify reception in advance, subject to availability and payment of a corresponding supplement for the Late Check Out service. The amount of the supplement applied will depend on the departure time.

In case of early departure, the establishment reserves the right to charge the full amount of the reservation.

In case of additional expenses in accordance with the following stipulation, these may be invoiced at Check-out, if the USER has so decided.

Additional charges

The USER may make use of all the services offered by HOTEL PLACIDO Y GRATA during his/her stay. Some of these services, such as bicycle rental, entail an additional cost not included in the price of the reservation.

Likewise, the USER will be able to acquire the design and decoration articles present in the Hotel, or acquire them through our supplier, YOUR LIVING SPACE, SL, applying in this case a HOTEL PLACIDO Y GRATA guest discount.

The USERS will have available the prices and / or rates of services and / or products offered by HOTEL PLACIDO Y GRATA.

In the event of additional expenses incurred by the USER after invoicing, a new invoice will be issued for these items for payment. Said invoice will be sent to the USER’s registered address, or to the USER’s email address, in the event that the USER has left the facilities.

Termination of the contract or cancellation of the booking

The cancellation of the reservation by the USER will entail the application of the expenses derived from this, in accordance with the cancellation policy in force at the time of the reservation.

Once the hour of the day of the reservation has elapsed without the USER arriving at the HOTEL PLACIDO Y GRATA facilities, the contract will be terminated ipso facto, with the application of the penalty for no-show equal to the contracted amount of one (1) night.

Complaints

Any complaint that the USER considers appropriate will be dealt with as soon as possible, and can be made by e-mail to hola@placidoygratahotel.com.

Online Dispute Resolution

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the parties, without recourse to the courts of law, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between the two parties. This body is neutral and will dialogue with both parties in order to reach an agreement, and may finally suggest and/or impose a solution to the conflict.

Force majeure

The parties shall not be liable for any failure due to force majeure. Performance of the obligations shall be delayed until the cessation of the case of force majeure.

Jurisdiction

The USER may not assign, transfer or transfer the contracted rights, responsibilities and obligations.

Should any provision of these terms and conditions be deemed invalid or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected in any way, nor shall they be modified in any way.

The USER declares that he/she has read, knows and accepts these Conditions in their entirety.

Applicable law and jurisdiction

These conditions shall be governed by or construed in accordance with Spanish law in that which is not expressly stated. HOTEL PLACIDO Y GRATA and the USER agree to submit to the courts and tribunals of Seville any dispute that may arise from the provision of the services covered by these Conditions.
